Use of College Facilities - FAQs
What is a college facility?
A college facility includes any MCCCD buildings, other structures, or land. This term covers everything from athletic fields and parking lots, to storage sheds and auditoriums.
Can college facilities be used for non-MCCCD activities?
Yes, within the guidelines of state law and MCCCD policies. The college is prohibited from entering into an agreement where the use of the facilities is strictly for personal or business purposes, or does not have some relationship to the college mission of education and training.
Can college facilities be used for any kind of activity?
The college is not obligated to permit usage for any activity that may be contrary to public policy or the safety of the persons involved or property used; or in the best interest of MCCCD.
Why is insurance required?
State law requires that non-MCCCD parties submit certificates of insurance.

What about advertising?
The college has the right to approve any advertising concerning a non-MCCCD party's use of college facilities.
Why does the college charge a rental fee to non-MCCCD employees and businesses?
State law requires that public entities, like colleges, receive "fair value" for the use of their facilities. The college charges non-MCCCD entities, including non-profits and other public entities, a "fair value rent" in exchange for use of the facilities.
Are there other ways for the college to receive "fair value" instead of paying rent?
Yes, there are many other ways to receive "fair value"; all must be documented and approved using the standard Facilities Use Agreement. The most common other ways are:
- Co-Sponsorship: The college may co-sponsor the activity. This means that the college must be an announced and publicized co-sponsor of the activity and that a college employee must be in attendance during the activity.
- Relationship to College Mission: The college determines that the activity is directly related to the college mission of education and training; and the college will obtain specific public benefits from the activity; and the activity is not political; and the value the college receives from the activity is equivalent to the amount of the rent.
- Professional Organization: The professional organization of which a college employee is a member may, with administrative approval, use the facilities without rent or insurance if the employee is responsible for managing the event and participates in the event; and If the objectives of the professional organization directly relate to the employee's work at the college; Note: Reasonable reimbursement of expenses may be required.
